The petitioners / A1 and A2, who were arrested and remanded to judicial custody on 19.03.2023 for the offence punishable under Sections 8(c) read with Section 20(b)(ii)(C), 29(1) of the NDPS Act in Crime No.102 of 2023 on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioners were found in possession of 21 Kgs of Ganja. Hence the case was registered against the petitioners.
3.It is stated that though investigation has been completed and final report had also been filed and the same is taken cognizance as C.C.No.708 of 2023, the trial is yet to commence.
4.Let the trial commence and the material witnesses also be examined. Since there is always a possibility of the petitioners absconding the judicial process, this Court is not inclined to grant bail to the petitioners and accordingly, this criminal original petition stands dismissed. 06.10.2023 smv https://www.mhc.tn.gov.in/judis
