O R D E R
The petitioner, who was arrested at the hands of the respondent police on 17.06.2025 for the alleged offences under Sections 409, 420 of IPC r/w 34 of IPC and Section 5 of TNPID Act, 1997 in Crime No.14 of 2023 seeks bail.
2. The case of the prosecution is that the petitioner/Accused No.12 along with other accused under the guise of giving high returns on investments, received a sum of Rs.6 lakhs from the defacto complainant and thereafter, cheated the defacto complainant. Subsequently, investigation revealed that this petitioner joined with other accused, started few investment companies and received huge funds nearly Rs.6 crores, by making misrepresentation and diverted the funds.

The learned counsel for the petitioner submitted that the petitioner was just an employee in accused company and that he had no role or never dealt with any of the finance, accounts of the accused company. He also submitted that the petitioner has not been named in the FIR and he has been falsely implicated in this case subsequently. Hence, he prays for grant of anticipatory bail to the petitioner herein.
4. The learned Government Advocate (Crl.side) would submit that the investigation is under progress and at a crucial stage. So far, 120 witnesses have been examined by police in which, 90 are victims/investors and 30 are materials witnesses from other relevant backgounds and money cheated
herein is nearly Rs.6 Crores. He would also submit that if bail is granted to the petitioner, there is possibility of tampering the witnesses. Therefore, he strongly opposed for grant of bail to the petitioners.
5. It is seen that the investigation in this case has just started and amount involved in this case amounted to Rs.6 crores, so far money cheated are not recovered, co-accused are still absconding and at this stage, this Court is not inclined to grant bail to the petitioner.
