Respondent PETITION under Article 226 of The Constitution of India praying for the issuance of Writ of Certiorarified Mandamus to call for the records of the impugned order dated 08.12.2016 in G.D.No.1634/2016-2017 by the respondent and to quash the same and consequently, release the goods in the vehicle bearing No.TN.52H-5168 it is covered under invoice No.RR/16-17/0384 & RR/16-17/0384 dated 03.12.2016.

O R D E R

1.Learned counsel for the petitioner says, that in order to expedite the release of goods, he shall make the payment of one time tax, albeit, under protest to the respondent within two days.

2.It is ordered accordingly. On receipt of deposit of money, the respondent will release the detained goods forthwith. https://hcservices.ecourts.gov.in/hcservices/

3.Mr.Kanmani Annamalai, says that, since, Form JJ has been filed, after issuance of compounding notice, this Writ Petition can be disposed of with liberty to the petitioner to challenge the compounding notice before the concerned authority. 4.The writ petition is accordingly, disposed of, with a liberty to the petitioner to challenge the compounding notice before the concerned authority. Consequently, connected Miscellaneous Petition is closed. There shall, however, be no orders as to costs.
