O R D E R

This writ petition has been filed challenging the order passed by the third respondent dated 24.03.2015 and the consequential proceedings of the fourth respondent dated 28.08.2019 thereby directing the sixth respondent to lay pipeline through the water channel which is classified as Odai Poramboke.

While pending the writ petition, the entire pipeline has been laid in the land comprised in survey No.55/1, 58/2, 63/1 and 63/2 which is classified as Odai Poramboke to draw water to irrigate the sixth respondent's land. Further, the petitioner is being adjacent land owner of 2/4

the Odai Poramboke has absolutely no grievance due to the permission granted by the third respondent and the fourth respondent. Even if any damage is caused to the pipeline, the water will easily flow through the water channel. Therefore, the grievance of the petitioner that there is no possibility of extending the water channel does not arise and no prejudice would be caused to the petitioner. Due to private dispute between the petitioner and the sixth respondent, present writ petition has been filed. Therefore, this Court finds no infirmity or illegality in the impugned orders passed by the third and fourth respondents. 3.

In view of the above discussion, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
