ORDER

This writ petition has been filed seeking to direct the respondents to measure the property more fully described in the prayer to this writ petition as per the petitioner's sale deed dated 15.06.1974 and thereafter to issue patta in favour of the petitioner for the entire extent of the land. 2.The case of the petitioner is that even though the sale deed dated 15.06.1974 standing in the name of the petitioner discloses that the extent of the land owned by the petitioner is 22 1⁄2 cents, the respondents have issued patta for a lesser extent.

3.The petitioner has given a representation to the respondents seeking for rectification of the patta. Since the same has not been considered till date, the petitioner has filed this writ petition.

4.A counter has been filed by the 1st respondent stating that the petitioner has not provided any documentary evidence before the respondents to prove that the petitioner is entitled for a larger extent of land as prayed for in this writ petition.

5.Learned counsel for the petitioner would submit that the sale deed produced by the petitioner discloses the correct extent of land held by the petitioner.

6.In view of the dispute raised by the 1st respondent through their counter, this Court is of the view that no prejudice would be caused to the respondents if the petitioner's representation seeking for rectification of patta is considered on merits and in accordance with law, by providing an opportunity of personal hearing to the petitioner to submit all the supporting documents in support of the petitioner's claim as prayed for in this writ petition. 7.This Court is not expressing any opinion on the merits of the petitioner's application.

8.For the foregoing reasons, this Court directs the 1st respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 10.11.2023, seeking for rectification of the patta for the property more fully described in the prayer to this writ petition, by disclosing the extent of petitioner's property as 22 1⁄2 cents as per the sale deed dated

15.06.1974, which is standing in the name of the petitioner, after providing one personal hearing to the petitioner, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
