This petition is filed to direct the learned Judicial Magistrate No.II, Krishnagiri, to recall the non-bailable warrant issued against the petitioner without insisting his presence in S.C.No.852 of 2016.

2. The learned counsel for the petitioner submitted that he was unable to appear before the Judicial Magistrate No.II, Krishnagiri, as he was suffering from severe jaundice; he also undertakes that the petitioner will appear on all future hearing regularly.

3. The petitioner is at liberty to file a petition under Section 70(2) Cr.P.C. before the Judicial Magistrate No.II, Krishnagiri. and avail the remedy open to him. On filing of such petition by the petitioner, the learned Judicial Magistrate No.II, Krishnagiri shall consider the same and pass orders in accordance with law.
