Prayer : Habeas Corpus Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus, to call for the records relating to the detention order passed by the second respondent pertaining to the order made in CPT No.50/2023 dated 22.08.2023 is detaining the detenue under 2(b) of Tamil Nadu Act of 1982, as a Bootlegger and quash the same and direct the respondents to produce the detenue Selvam, S/o.Venu, aged about 36 years, who is detained at the Central Prison, Puzhal, Chennai, before this Court and set him at liberty. (Order of the Court was made by S.S. SUNDAR, J.) The petitioner, wife of the detenu, namely Selvam, S/o.Venu, aged about 36 years, has come forward with this petition challenging the detention order passed by the 2nd respondent dated 22.08.2023 slapped on her husband, branding him as "Bootlegger" under the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest
Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, Slum Grabbers and Video Pirates Act, 1982 [Tamil Nadu Act 14 of 1982]. 2.The learned Additional Public Prosecutor would submit that the order of detention passed by the second respondent as against the husband of the petitioner herein dated 22.08.2023 has been revoked by the Government in G.O. [Rt] No.5525, Home, Prohibition & Excise (XI) Department, dated 04.10.2023 and he has also produced a copy of the said order.
