Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to disburse the Gratuity, General Provident Fund, Special Provident Fund, Encashment of Earned Leave and Encashment of Un-earned Leave on private affairs to the petitioner.

ORDER
The petitioner, after being appointed as Village Administrative Officer in the Revenue Department on 26.10.87, was re-designated as Special Grade Village Administrative Officer on 22.11.2013. However, as he was involved in a Vigilance and Anti-Corruption criminal case, he was arrested, resultantly he was suspended from service by order dated 23.11.2013.
He is presently facing both departmental proceedings as well as criminal proceedings. In the meanwhile, the petitioner attained the age of superannuation on 31.10.2016. Therefore, he has given a representation on 28.11.2016 making a request to disburse his retiral benefits. But there is no reply. Therefore, he has been advised to come to this Court.
2. Mr.K.Dhananjayan, learned Special Government Pleader, taking notice on behalf of the respondent, submitted that if the benefits sought for by the petitioner in the pending representation comes within the permissible limits as per law, such benefits will be disbursed by disposing of his representation.

Recording the statement of the learned Special Government Pleader for the respondent, the respondent is directed to consider the representation of the petitioner on merits and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
