ORDER

By order dated 18.06.2025, the plaintiff was permitted to file an application for substituted service on the first defendant after noticing that the notice sent to the only available address of the first respondent was returned with the endorsement "notice returned; addressee left without instructions". It was also recorded therein that the second defendant, which had a business relationship with the first defendant, was directed to provide the address of the first defendant and had stated that the address set out in the cause title is the only available address. In the above facts and circumstances, this application is liable to be allowed by permitting the plaintiff to effect substituted service in the application on the first respondent/first defendant.

2. Accordingly, this application is allowed on the following terms: (i) The applicant is permitted to effect substituted service by publication in one issue of the English Daily "Indian Express", Bombay Edition and one issue of the Hindi Daily "Navbharat", Mumbai Edition specifying the next date of hearing as 08.09.2025.

(ii) Notice shall also be affixed on the last known address and on the Court Notice Board.

List the matter on 08.09.2025.
