Ms.S.Rithu, Assistant Commissioner of Police, EDF-III, Central Crime Branch, Vepery, Chennai is present before this Court and filed a status report.

2. The Assistant Commissioner of Police submitted that as regards Crime No.29 of 2017 - "Brindavan" project, 18 victims have been settled. As regards Crime No.30 of 2016 - "Savithanjali" project, there are totally 14 victims, of which, 12 victims have been settled and 2 victims are insisting for handing over of Flat. With regard to Crime No.137 of 2017 there are 20 victims, which also pertains to "Savithanjali" project. The builder is promising to handover the physical possession of the property by February, 2023. The issue herein is also likely to be settled.

3. Mr.Ralph V.Manohar, learned counsel appearing for the de-facto complainants/victims submitted that as regards these two projects they are willing to grant four weeks time for the builder to complete construction and Page 1/4

hand over the same. With regard to Crime Nos.133 and 138 of 2017, there are totally 31 and 28 victims, respectively. Some of the victims are willing to get back the amount and some are insisting for Flats.

4. The Assistant Commissioner of Police submits that most of the victims are not traceable. She is taking earnest steps to collect the details. The accused-company and accused are not providing full details. In view of the same, the petitioners/accused is directed to furnish the details of the purchasers/victims, their bank particulars, loan particulars and contact details to the Investigating Officer within a period one week, i.e. on or before 28.11.2022.

5. The Assistant Commissioner of Police is directed to collect the details from the Bank about the victims to establish contact or any form of communication and to ascertain the victims' willingness for settlement by cash or physical possession of the Flat. Further, the Assistant Commissioner of Police is directed to visit the project places, viz., Brindavan, Savithanjali, Utsav and Maha Utsav and ascertain the physical conditions and features whether at all the project is in progress or can be completed as projected by Page 2/4

February, 2023. If needed, an independent assessment can be made by availing the services of an Expert/Engineer.

6. Post the matter on 20.12.2022.
