The petitioner seeks bail in Crime No.17 of 2023 registered by the respondent police for the offences punishable under Sections 376(2) of IPC and Section 5(1) r/w Section 6(1) of POCSO Act, 2012.

2. It is stated that the petitioner, who is aged 20 years had physical relationship with the victim child, who was aged 14 years.

3. It is also stated that the statement under Section 164 Cr.P.C., of the victim child had been recorded and it is a story of grief complaining that the petitioner had been deserted her and had disclaimed all knowledge about her. It is stated that the petitioner had committed aggravated penetrative assault on the victim child.

4. Taking into consideration all these facts and the fact that the petitioner had practically deserted the victim child, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
