ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.V, Salem, to dispose of the case in accordance with law in CC No.1211 of 2020 within a stipulated time.

2. The case of the petitioner/defacto complainant is that towards the borrowed amount, he had executed a sale agreement as collateral security in favour of A2. Since the petitioner /defacto complainant was unable to repay the said borrowed amount in time, A2, in connivance with other accused, is alleged to have forged the documents, transferred the property to a third party and further accused threatened the defacto complainant.

3. Thereafter, based on the complaint, the respondent police conducted an investigation and filed a final report before the Judicial Magistrate V, Salem on 19.03.2020 and the same has been taken on file as CC No.1211 of 2020. Though five years have lapsed, the trial has not yet commenced. Hence, the 2/4

present petition has been filed.

4. Heard both sides and perused the materials available on records carefully.

5. On perusal of the B-diary, it is seen that the matter has been pending from 20.01.2021 and is now posted for enquiry in Crl.M.P.No.984 of 2021. Considering the same, the learned Judicial Magistrate No.V, Salem, is directed to conduct the trial in C.C.No.1211 of 2020 and dispose of the same as expeditiously as possible.

6. With the above directions, this Criminal Original petition is disposed of.
