The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b) and 506(II) of I.P.C and Section 67 of Information Technology Act 2000, in Crime No.472 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the de-facto complainant had lodged a complaint that on 10.07.2023, the petitioner had posted the whatsapp post and facebook posters against Mr.Thirumavalavan, the leader of the 'Tamil Nadu Viduthalai Chiruthigal Katchi' and again further 3 messages posted on 11.06.2023, 12.06.2023 and 10.07.2023 and it is seen that the petitioner had also given a complaint which has been registered in Crime No.471 of 2023. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is a innocent. He has been falsely implicated in this case. Hence, he prays to grant to anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that substantial part of the investigation had not been done. Hence, he opposed for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2

Crl.O.P.No.22941 of 2023 C.V.KARTHIKEYAN,J., nvi 5.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and on perusing the issues and materials which have been produced to show that the the nature of the messages which had been provided which shows that the petitioner has indulged himself in the alleged offence, in this aspect and in view that the investigation is required to be conducted, this Court is not inclined to grant bail to the petitioner.
