O R D E R

The above writ petition is filed seeking a direction to the respondents to pass orders on the petitioner's representation dated 19.06.2025 within a stipulated time.

The petitioner would submit that she was appointed in the Transport Department through the Tamil Nadu Public Service Commission as an Assistant and joined duty in the Regional Transport Officer, Chennai (West) on 19.12.2012. Her services was regularized by order dated 30.01.2015. She was posted as Accountant at the Regional Transport Office, Tambaram on 08.01.2016. Later, she was posted to the Office of the Transport Commissioner, Chennai on 22.06.2023 where she is currently working.

3. The petitioner would further submit that she had completed her probation and passed the requisite departmental tests. Her probation was declared with effect from 18.12.2014. However, no increment has been granted to the petitioner to date and she is drawing the same salary which was fixed on 01.10.2013.

4. Due to a medical emergency, the petitioner was hospitalized and undergone medical treatment for certain period which was declared as unauthorized absence. Consequently, 17(b) charges were issued against her. By order dated 27.06.2023, the respondent had imposed a punishment of stoppage of increment for two years without cumulative effect, which expired on 27.06.2025.

5. Despite fulfilling all the necessary qualifications and successfully completing her probation, the petitioner was not considered for promotion to the post of Superintendent. Her juniors were promoted and her name was excluded from the seniority list. The respondent, in his proceedings dated 19.02.2024, has wrongly stated that her probation was not declared and that the punishment was still in force. The petitioner submitted a representation dated 19.06.2025 requesting the respondents to re-fix her seniority and grant promotion with effect from the date on which her juniors were promoted. The said representation was received and acknowledged by the respondent on the very same day. However, no action has been taken to date. Therefore, the petitioner is before this Court.

6. Heard the learned counsels on either side and perused the materials available on record.

7. This Court taking into consideration the above facts and circumstances of the case is of the view that it would suffice to direct the respondent to dispose of the representation dated 19.06.2025. Accordingly, without going into the merits of the case, this Court directs the respondent to dispose of the representation of the petitioner's dated 19.06.2015, in accordance with law within a period of two months from the date of receipt of copy of this order.

7. With the above directions, this Writ Petition is allowed. No costs.
