PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of a writ of Mandamus directing the Central Administrative Tribunal Chennai Bench to dispose the OA No.595 of 2020 to fix the time frame and pass suitable orders within a stipulated time.

ORDER

(Order of the Court was made by D.KRISHNAKUMAR, J.) By consent of parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The writ petitioner had joined the Postal Department as Gramin Dak Sevaks Branch Post Master (GDS BPM) in the year 2010. The third respondent has passed an order in Order No.17-39/4/2012GDS dated 14.01.2015, insofar as the condition of cut off date 01.09.1993 prescribed for absorption as GDS is concerned. Against the said order, the writ petitioner has made an application in OA No.595 of 2020 before the Central Administrative Tribunal. A reply statement has been filed by the respondents in the said OA. The said OA is pending before the Tribunal for the past three years. Therefore, the petitioner has filed the present writ petition seeking direction for early disposal of the said OA.

3. Learned Standing Counsel for the respondents stated that a reply statement has been filed by the respondents and the respondents will co-operate for the disposal of the said OA.

4. In view of the said submissions made by the parties, and considering the limited scope of the prayer as sought for in the writ petition and in view of the fact that the said OA has been filed in the year 2020 and the same is pending for three years, without expressing any opinion on the merits of the case, we direct the Tribunal to consider and take appropriate decision in the said OA, as early as possible, within a period of four months from the date of receipt of a copy of this order.

5. With the above directions, the writ petition stands disposed of. There will be no order as to costs.
