PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the 1st respondent to remove the case properties pertaining to Crime No.424/2017 on the file of the 1st respondent stored in petitioner's warehouse within period of one week.

In view of the statement made by both sides, as recorded in the order dated 28.11.2019 in Crl.O.P.No.703 of 2018, the petitioner is at liberty to remove the goods, namely, the properties pertaining to Crime No.424 of 2017. Incidentally, the properties happen to be biscuits which are perishable items and have been lying in the godown since 2017 and it is also stated that the goods have totally perished.

2.The respondents shall not raise objections to the removal of the said goods.
3.The Criminal Original Petition is allowed.
