Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 23.09.2019, and to direct the second respondent to cancel the patta issued in favour of the third respondent in patta No.902, Vedal Village, Vandavasi Taluk, Thiruvannamalai District for the lands situated in Vedal Village in Survey No.233/10B for an extent of 0.4.16 and reverse the entries as it stood originally and conduct fresh enquiry. ORDER
The petitioner herein aggrieved by the inclusion of the 3rd respondent name in the patta No.902 vide Survey No.233/10 at Vedal Village, Vandavasi Taluk, Thiruvannamalai District, has given a representation to the Tahsildar/2nd respondent to cancel the patta issued in favour of the 3rd respondent. https://hcservices.ecourts.gov.in/hcservices/
2.According to the petitioner, land measuring 0.56.50 Hectare in Survey No.233/10 belongs to him and patta No.416 was issued to him. While so, without his knowledge, separate patta to an extent of 45 cents has been issued to the 3rd respondent in the said Survey number. Though the representation was given to the to the 2nd respondent on 23.09.2019, to delete the name of the 3rd respondent, the same has not been considered by him. Hence, the present writ petition is filed seeking Mandamus.
3.After notice, the learned Government Advocate appearing for the 2nd respondent took instructions and report to this Court that pursuant to the representation of the petitioner, the enquiry process initiated and summoned to concerned parties to appear on 08.11.2018. He further submits that if the parties co-operate for the enquiry, it will be completed within a period of three weeks.
4.In the light of the above submissions, this writ petition is disposed of with a direction to the 2nd respondent to dispose of the representation of the petitioner dated 23.09.2019 as expeditiously as possible. No costs.
