ORDER

This writ petition has been filed challenging the legal heirship certificate dated 23.01.2024 issued by the respondents and for a consequential direction to the respondents to issue legal heirship certificate by including the name of the petitioner, who is sister of the deceased V.Subramaniyan.

2. The grievance of the petitioner is that her brother was a bachelor and he died on 07.10.2023. However, one Chinnammal @ Lakshmi has projected as if she is the wife of the petitioner's brother and applied for a legal heirship certificate, and the legal heirship certificate was issued as if she is the wife of the deceased V.Subramainan. Aggrieved by the same, the petitioner submitted a representation to the respondent seeking for cancellation of the legal heirship certificate. Since, the same did not evoke any response, the present writ petition came to be filed before this Court.

3. When the matter is taken for hearing today, the learned Government Advocate appearing on behalf of the respondents produced the written instructions received from the respondent. On going through the same, it is seen that the respondent is willing to enquire into this matter after affording opportunity to the parties and take a decision.

4. The learned counsel for the petitioner submitted that the said

Chinnammal @ Lakshmi died on 30.11.2024 leaving behind her husband namely Natarajan and son Shankar. The learned counsel for the petitioner therefore submitted that it is quite apparent that the deceased, while she was already married, has illegally obtained the legal heirship certificate.

5. Taking into consideration the facts and circumstances and considering the written instructions received from the respondents, there shall be a direction to the respondent to deal with the complaint given by the petitioner and enquire the same after affording opportunity to all the interested parties and take a decision within a period of six weeks from the date of receipt of a copy of this order.
