ORDER

The petitioner has filed the present Writ Petition praying for issuance of a Writ of Mandamus to direct the respondent to disburse the 6% interest for belated payment of Provident Fund, Gratuity, Pension commutation and Earned leave surrender amount within the stipulated time as may be fixed by this Court.

2. The petitioner is a retired Selection Grade Senior Conductor of the Tamil Nadu State Transport Corporation (Salem) Ltd., and he joined service on 15.07.1985 and retired on 31.05.2018 after putting in unblemished service 1 / 4

record. His retirement benefits, including Provident Fund, Gratuity, Pension Commutation and Earned Leave surrender, were paid belatedly only on 22.09.2019. Despite submitting a representation, dated 22.07.2025 seeking interest for the delayed payment of the above benefits, the respondents have not responded or settled the dues. Hence, the petitioner has filed the present Writ Petition for the relief stated supra.

3. Heard both sides and perused the materials available on record.

4. The petitioner's case is similar to that of the petitioner in W.P.No.1810 of 2025, in which, this Court had disposed of the said Writ Petition on 27.01.2025 with necessary direction. Hence, following the same, the present Writ Petition is to be disposed of.

At this juncture, the learned Standing Counsel appearing for the respondents submitted that in view of the similar order passed by this Court in the other Writ Petitions, in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest @ 6% per annum for the belated payment of the eligible and admissible amounts of retirement benefits.

Hence, the respondents are directed to pay interest @ 6% per annum upon the delayed payment of retirement benefits, from the date of retirement till the date of actual disbursement of the terminal benefits to the petitioner, within a period of 8 weeks from the date of receipt of a copy of this order, failing which, it will fetch interest @ 12% per annum from the date on which the amount became 2 / 4

due and payable till the date of actual realisation.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
