The petitioners seek anticipatory bail in Crime No.52 of 2022, registered under Sections 406, 420, 120-B IPC, with respect to an occurrence which had happened between 15.07.2021 and 15.10.2021. The FIR was registered on 20.07.2022.

2.It is the case of the prosecution that the petitioners and the other accused had given two JCB machines for lease to the defacto complainant for a period of six months. Amounts were also received amounting to more than Rs.20,00,000/-. It was then found that the JCB machines were actually stolen vehicles. Therefore, the complaint was lodged. It is also informed in the status report that one of the vehicles had been stolen in Virudhunagar. In that connection, Crime No.01 of 2022 had been registered by the DCB Virudhunagar, under Sections 420, 406, 120 (B) IPC.

sli 3.The learned counsel for the intervenor stated that this is the modus operandi of the accused who steal the JCB vehicles and enter into a lease to hand over such JCB to victims from whom the police would seize them since they are naturally stolen vehicles. Status report had also been filed reiterating all these.
