O R D E R

The present Revision has been filed as against the order dated 18.06.2025 by the learned Judicial Magistrate No.VI, Coimbatore in Crl.M.P.No.4738 of 2025 thereby dismissed the petition filed under Section 175 (3) of BNSS, 2023.

2. Heard the learned counsel on either side and perused the documents placed on record.

3. On a perusal of the records it is seen that the petitioner lodged a complaint alleging that the property originally owned by his maternal grand father, thereafter, maternal grand father's son [maternal uncle of the petitioner] sold the land without giving any share to the petitioner's mother. In this regard, already civil suit is pending, therefore, no criminal case is made out as against the accused and as such, the trial court rightly dismissed the petition and this Court finds no infirmity in the order passed by the trial court in Crl.M.P.No.4738 of 2025 dated 18.06.2025 by the learned Judicial Magistrate No.VI, Coimbatore. In view of the above, the present Revision stands dismissed.

However, the petitioner is at liberty to workout his remedy before the civil court in the manner known to law.
