By way of filing this writ petition, the petitioner seeks a direction to the first respondent / the Chief Executive Officer, Tamil Nadu Khadi & Industries Board, Chennai, to dispose of his pending appeal dated 27.10.2009 within a stipulated time.
2. Mr.K.Dhananjayan, learned Special Government Pleader takes notice of the second respondent and Mr.S.K.Bose learned counsel takes notice for the first respondent and with the consent of the counsel appearing on either side, the writ petition itself is taken up for final disposal.
3. The grievance of the petitioner is that though he was allowed to retire from service on 30.10.2009, his retirement benefits have not been settled. In the meanwhile, the https://hcservices.ecourts.gov.in/hcservices/
respondent had also passed recovery order dated 19.09.2009. Against the said recover order, he had also filed an appeal dated 27.10.2009, but, even now, the respondent did not pass any orders on the same. It is also stated that he has sent a reminder on 05.11.2016, which was duly acknowledged by the respondent.
4. Learned Special Government Pleader appearing for the second respondent sought two weeks time to dispose of the pending appeal within a period of four weeks.
5. Recording the above said statement, this Court directs the first respondent to dispose of the appeal dated 27.10.2009 filed by the petitioner within a period of four weeks from the date of receipt of a copy of this order on merits and in accordance with law. With this direction, the writ petition is disposed of. No Costs.
