Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus to call for the records and quash the notice issued by the 5th respondent dated 29.07.2025 and to direct the respondents to grant and extend the time till 30.10.2025 to surrender or deliver possession of the property extent of 45 Square Meter comprised in S.No.221/2B, bearing Patta No.261 situated at No.47, Mount Poonamallee Highroad, Kattupakkam, Chennai - 56. ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The relief sought in this writ petition is to quash the Notice dated 29.07.2025 issued by 5th respondent and to direct the respondents to grant and extend the time till 30.10.2025, to surrender or deliver possession of the property comprised in S.No.221/2B, measuring an extent of 45 Square Meter, bearing Patta No.261 situated at No.47, Mount Poonamallee Highroad, Kattupakkam, Chennai - 56 (hereinafter referred to as "subject property").

The learned counsel for the petitioner submitted that the subject property is a Marriage Hall and the same was booked for the marriage functions which are scheduled to be held on 20.08.2025, 27.08.2025, 28.08.2025, 29.08.2025, 03.09.2025, 04.09.2025, 05.09.2025, 10.09.2025 & 11.09.2025 and hence, the petitioner undertakes to surrender or deliver the possession of the subject property to 5th respondent, on or before 15.09.2025. The learned counsel for the petitioner has also produced a Memo dated 13.08.2025 filed by the petitioner, before this Court to that effect. Further, the learned counsel for the petitioner prayed that the Memo filed by the petitioner may be recorded and this writ petition may be disposed of in terms of the said Memo.

4. The Memo dated 13.08.2025 filed by the petitioner reads as follows:

"It is respectfully submits as follows:

1. The petitioner submit that the petitioner filed this writ petition to direct the respondents to grant time to extend the time till 30.10.2025 to surrender or deliver possession of the acquired property.

2. The petitioner submit that today this writ petition came up for admission before this Hon'ble Court. The petitioner was booked his 3/6

marriage hall for the marriage functions on 20.08.2025, 27.08.2025, 28.08.2025, 29.08.2025, 03.09.2025, 04.09.2025, 05.09.2025, 10.09.2025 and 11.09.2025. This petitioner hereby undertakes to surrender or deliver the possession of the acquired property, on or before 15.09.2025, to the 5th respondent.

Therefore, it is prayed that this Hon'ble Court may be pleased to accept and record this Memo and thus render justice."

Considering the submission made by the learned counsel for the petitioner, Memo dated 13.08.2025 filed by the petitioner is recorded and this Writ Petition is disposed of in terms of the Memo dated 13.08.2025 filed by the petitioner.
