Criminal Appeal is filed under Section 14(A) of SC/ST Act, to call for the records in M.P.No.1 of 2025 in Spl.S.C.No.77 of 2024 dated 14.07.2025 on the file of the learned Judge Special Court for Trial Cases under SC/ST Act (POA) Tiruppur and set aside the judgment and allow the appeal as prayed. 1/4

JUDGMENT

This appeal has been preferred as against the order dated 14.07.2025 made in M.P.No.1 of 2025 in Spl.S.C.No.77 of 2024 on the file of the learned Judge Special Court for Trial Cases under SC/ST Act (POA) Tiruppur, thereby dismissing the petition to discharge the petitioner from the charges.

2. The petitioner is now facing charge for the offence under Section 352, 323, 506(ii) IPC and Section 3(1)(r), 3(1)(s), 3(2)(va) of the SC/ST Act, alleging that the petitioner committed assault on the victims by his hands and legs and also abused them with filthy language.

3. On perusal of statement recorded under Section 161(3) Cr.P.C. from the victim, the second respondent herein, it is revealed that they are doing irrigation at the lands owned by one Premalatha. In respect of the said land there is a civil dispute pending between the said Premalatha and her sister Radhika. While being so, on 12.06.2024 when the second respondent and another, while irrigating the said land, the petitioner came to the place of occurrence and attacked and abused them with filthy language. are specific allegations as against the petitioner to constitute the offence under Section 352, 323, 506(ii) IPC and Section 3(1)(r), 3(1)(s), 3(2)(va) of the SC/ST Act. Hence, the trial Court has rightly dismissed the petition to discharge the petitioner and this Court finds no illegality or infirmity in the order passed by the trial Court.

4. Accordingly, this Criminal Appeal is dismissed. Consequently, connected miscellaneous petition is closed.
