This Criminal Original Petition has been filed to set aside the order dated 22.08.2022 in C.M.P.No.2400 of 2022 in C.C.No.309 of 2012 on the file of 1/5
Judicial Magistrate No.I, Tiruppur.
2.It is seen from the submission of learned counsel for the petitioner that P.W.3, P.W.4, P.W.8, P.W.10 and P.W.13 had not been cross examined. Petition filed for recalling these witnesses for the purpose of cross examination was dismissed and therefore this petition.
3.The learned Government Advocate (Criminal side) submitted that these witnesses had not been cross examined. Therefore, with a view to given an opportunity to the petitioner for cross examination of these witnesses, order dated 22.08.2022 passed in C.M.P.No.2400 of 2022 in C.C.No.309 of 2012 on the file of the learned Judicial Magistrate No.I, Tiruppur is set aside and the petitioner is given permission for cross examination of P.W.3, P.W.4, P.W.8, P.W.10 and P.W.13 on payment of cost of Rs.1000/- to each witnesses and on the condition that the cross examination should be completed on the same date when the witnesses are produced before the Court.
4.Accordingly, this Criminal Original Petition is disposed of. 15.12.2022 2/5
