Respondent Prayer:Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the respondents relating to the Tender Cum auction notice in Na.Ka.No.A1/185/2013 dated 09.06.2017 particularly with regard to Condition No. 47 and the consequential re-auction notice dated 13.11.2017 published in the newspapers on 18.11.2017, quash the same and consequently direct the respondent to accept the payment of a single common EMD for the tender cum auction process for the shops numbers 1 1/4

to 14, 16 to 24 and the Vegetarian Restaurant in the Thirukoilur Bus Stand and enable the bidders of bid for any of the shops of their choice instead of separate EMDs for each shop and restrict the allotment of shops as one shop per successful bidder.

ORDER

This writ petition is filed challenging the Tender Cum auction notice in Na.Ka.No.A1/185/2013 dated 09.06.2017 particularly with regard to Condition No. 47 and the consequential re-auction notice dated 13.11.2017 published in the newspapers on 18.11.2017, quash the same and consequently direct the respondent to accept the payment of a single common EMD for the tender cum auction process for the shops numbers 1 to 14, 16 to 24 and the Vegetarian Restaurant in the Thirukoilur Bus Stand and enable the bidders of bid for any of the shops of their choice instead of separate EMDs for each shop and restrict the allotment of shops as one shop per successful bidder.

2. When the case was taken up, the learned counsel for the respondent 2/4

submitted that since the contract period is of the year 2017 and the period is till 2020. Now, the relief sought for in this writ petition has become infructuous.

3. Such view of the matter, this writ petition stands dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
