The petitioner is an accused in Crime No.174 of 2023 registered by the respondent police for the offence punishable under Section 395 of IPC, and he had been arrested and remanded to judicial custody on 01.08.2023. Hence, he seeks bail.
2. It is stated that the defacto complainant along with his brother and friend had celebrated birthday. At that time, they had consumed alcohol and ganja and the petitioner along with other accused had joined with the defacto complainant and thereafter, robbed their gold chain, gold ring and other valuable items. It is stated that there are ten previous cases pending against the petitioner herein and investigation has not yet been completed.
3. Taking into consideration the bad antecedents of the petitioner and investigation has not been completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
