ORDER
On the complaint given by one Tamilarasi alleging that two persons in two wheeler snatched her hang bag in which she had kept Rs.500/- and Samsung mobile phone along with house key, a case in Crime No.382 of 2025 dated 16.07.2025 was registered for the offences under Sections 304(2) of BNS Act, 2023.
2. This petitioner was arrested on 21.07.2025 and the handbag, mobile phone, Rs.500/- cash kept in the handbag of the victim was recovered from the accused. The co-accused/A2 is a juvenile. Earlier bail petition before the District Court was dismissed on the ground that investigation is pending.
3. The learned Government Advocate (Crl.side) states that from this petitioner the stolen articles were recovered and investigation is almost completed and likely to file a final report soon.
4. Recording the same, this Court is inclined to grant bail to the petitioner with certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Metropolitan Magistrate-II, Egmore, Chennai, and on further conditions that :

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the Investigating Officer as and when required for interrogation.
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 11.08.2025 nr Page No.3/5
