The petitioner seeks bail in Crime No.445 of 2023, registered by the respondent police for the offences punishable under Sections 120B, 294(b), 506(i), 406 & 420 of IPC.
2. Earlier application for anticipatory bail in Crl.O.P.No.19800 of 2023 had been dismissed by my learned predecessor on 01.09.2023. It had been observed even at that time that the accused persons were running an unregistered chit fund in the name of 'Saratha Women Welfare Group' and had collected a sum of Rs.50,81,000/- from 25 victims. The petitioner is the 5th accused and none of the accused have repaid any amount.
3. It is seen that still the amounts have not been repaid and still the accused had not been taken into custody
4. Taking those factors into consideration and there is no change in circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
5. The Investigating Officer is directed to take the petitioner into custody and report to this Court on 15.11.2023. Otherwise strictures will be passed against the Investigating Officer.
