The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 4(1)(aaa), 4(1-A)(ii) of TN Prohibition Act in Crime No.507 of 2023 on the file of the Respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 19.08.2023, the Petitioner and associates illegally possessed 90 ml Old Secret XXX Rum 96 pocket and Karnataka Government Pockets 432 litres. Hence the complaint. 3.Learned counsel for the Petitioner would submit that the Petitioner was falsely implicated in this case and he is an innocent person. Learned counsel for the Petitioner seeks grant of anticipatory bail to the Petitioner. 4.Learned Government Advocate (Crl. Side) would submit that the Petitioner was in possession of 90 ml Old Secret XXX Rum 96 pocket and Karnataka Government Pockets 432 litres. He vehemently opposed to grant anticipatory bail to the Petitioner.

5.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. Side) appearing for the Respondent Police. 6.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the nature and gravity of the offence and the fact that previous cases, which are similar in nature are also pending against the Petitioner, I am not inclined to grant anticipatory bail to the Petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 29.09.2023 sai 2/ 3
