ORDER

This writ petition has been filed for the issue of writ of Mandamus forbearing the respondents 1 and 2 from in any manner disrupting the electricity supply given to the residence and the shops belonging to the petitioner situated in the subject property.

The grievance of the petitioner is that she has a share in the property and already a suit has been filed by the petitioner in OS No.78 of 2024 before the Principal District Judge, Kallakurichi as against respondents 3 to 5 seeking for the relief of partition and allotment of 1/4th share in the property. While so, the 4th respondent, who is the brother of the petitioner made a request to the 1st respondent to disconnect the service connection and based on the same, the service connection that was provided to the shop was disconnected and steps are being taken to disconnect the service connection which was given for the residence of the petitioner. It is under these circumstances, the present writ petition came to be filed before this Court.

When the matter was taken up for hearing today, the learned Standing counsel appearing on behalf of respondents 1 and 2 submitted that commercial service connection was given for the ground floor where earlier TASMAC shop was being run and later it was closed. Residential service connection was given in the 1st floor. Insofar as the ground floor is concerned, the service connection was

disconnected based on the request made by the 4th respondent. It is also stated that the petitioner is not running the shop in the ground floor but at an adjacent place which has nothing to do with the property for which service connection has been given by the electricity board. Therefore, the commercial service connection that was given to the two shops in the ground floor has been disconnected and no steps are being taken to disconnect the residential service connection given to the first floor.

This Court had the advantage of glancing through the photographs placed before this Court. It is seen that the petitioner is running the shop adjacent to the building for which the service connection was given. Therefore, this Court is inclined to safeguard the interest of the petitioner insofar as the residential portion is concerned. In view of the above, there shall be a direction to the respondents 1 and 2 not to disrupt the residential service connection that has been given for the 1st floor of the property. Insofar as the other grievances are concerned, it is left open to the petitioner to work her remedy in the manner known to law in the pending suit.
