This writ petition has been filed for the issue of writ of Mandamus directing the respondents to award proper marks to the petitioner in the physical test that was conducted on 07.11.2023 and to add the name of the petitioner in the selection list to the post of Sub-Inspector of Police. 2.
Heard M.Cinnaduari, learned counsel for the petitioner and Mr.Sowri Dattan, learned Standing counsel for R1 and R2 and Mr.P.Balathandayutham, learned Special Government Pleader for R3. 3.
In the considered view of this Court, the grievance expressed by the petitioner cannot be gone into by this Court in exercise of its jurisdiction 2/5
under Article 226 of the Constitution of India. According to the petitioner, he has jumped a distance of 4.50 meters in the long jump and whereas, the respondents have recorded /marked only 4.38 meters and as a result, he was not awarded with proper marks. The learned counsel for the petitioner also produced the snapshot of the video footages by way of filing typed set of papers. It is too difficult for this Court to get into this issue and find out regarding the exact distance which the petitioner had jumped. This Court must stay away from cases where it involves pure questions of fact. 4.
In view of the above, the relief as sought for by the petitioner cannot be granted by this Court and accordingly, this writ petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
