Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.RC.NO.1052 OF 2019 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on them in judgment made in C.C.No.222 of 2009 dated 29.01.2019 passed by learned J.M.No.I, Poonamallee, Thiruvallur District in confirmed in Crl.A.No.26 of 2019 dated 30.09.2019 by the learned II Additional District & Sessions Judge, Poonamallee, Thiruvallur District and enlarge the petitioners on bail pending disposal of this CRL.RC.NO.1052 OF 2019 [IN CRL.MP.NO.14413 OF 2019] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.RC.NO.1052 OF 2019 on the file of the High Court and upon hearing the arguments of M/S.S.SASIKUMAR, Advocate for the petitioner and of MR.C.
RAGHAVAN, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioners by judgment dated 30.09.2019 made in Criminal Appeal No.26 of 2019 by the learned II Additional District and Sessions Judge, Thiruvallur at Poonamallee , confirming the judgment of conviction as against the petitioners dated 29.01.2019 made in C.C.No.222 of 2009 by the learned Judicial Magistrate No.I, Poonamallee, Thiruvallur District, and enlarge the petitioners on bail, pending disposal of the above criminal revision.
2. Heard both sides.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is ordered and the substantive sentence of imprisonment alone is suspended on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Poonammallee and the petitioners shall appear before the trial Court on the first working day of every month at 10.30 a.m until further orders. In case any of the conditions are not complied with, the interim order of suspension of sentence shall stand vacated automatically without further reference to this Court. -sd/- 10/10/2019 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
