PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus directing the 1st Respondent to grant permission to blast the hillock in petitioner property situated at S.F. NO. 93/C4A in No.10, Muthur Village, Kinathukadavu Taluk, Coimbatore District with the help of explosives materials from the explosives licence holder and blast trained foremen for Agricultural purpose based on the petitioners representation dated 10.07.2025 within a time frame fixed by this Court.

ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to act upon the representation made by the petitioner on 10.07.2025 wherein the petitioner is seeking for granting permission to blast the hillock in the property belonging to the petitioner with the help of explosive license holder.

When the matter was taken up for hearing today, the learned Additional Government Pleader appearing for the
respondents submitted that the 3rd respondent has to deal with the representation and a report has to be submitted before the 1st respondent in order to enable the 1st respondent to take a decision on the request made by the petitioner. However, till date, the 3rd respondent has not received any representation from the petitioner. On going through the written instructions, it is further seen that in the very same area the petitioner has been granted quarrying licence for a period of three years during the years 1992 - 1995. Therefore, the 3rd respondent wants to verify the field condition before submitting the report before the 1st respondent to take a decision. 3.
Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court and also considering the written instructions received from the Joint Director of Geology and Mining, Coimbatore, there shall be a direction to the petitioner to submit a representation before the 3rd respondent along with the copy of the representation dated 10.07.2025 and all other relevant documents along with a copy of this order. On receipt of the same, the 3rd respondent shall conduct an inspection and take a decision and place the report before the 1st respondent within a period of six weeks from the date of receipt of
the representation from the petitioner. On receipt of the same, the 1st respondent shall take a decision within a period of eight weeks thereafter.

This writ petition is disposed of with the above directions. No costs.
