ORDER

This Criminal Original Petition has been filed seeking to quash the charge sheet in C.C. No. 520 of 2020 on the file of Judicial Magistrate Court, Madhavaram.

2. Heard both sides.

3. The petitioners are ranked as A1 and A3 in the F.I.R. in Crime No.37 of 2019 registered for the offence under Sec.341, 294(b), 324 and 506(ii) of I.P.C. Subsequently, the charge sheet has been filed and the same was taken on file in C.C.No.520 of 2020 on the file of Judicial Magistrate Court, Madhavaram and the same is pending. Now, the petitioner had filed this petition praying to quash the said charge sheet.

4. Today, when the matter taken up for hearing, both the petitioner and 2nd respondent/defacto complainant appeared in person along with their counsel respectively. They have submitted a joint memo of compromise and accordingly, the 2nd respondent/defacto complainant agreed to withdraw the case in C.C.No.520 of 2020 on the file of Judicial Magistrate Court at Madharavaram and agreed to maintain good Page No.2 of 4

relationship with the petitioner and also agreed that they will not enter any further dispute with regard to the above issue. The joint memo of compromise filed by them is recorded.

5. In view of submission of joint memo of compromise stating that the 2nd respondent is not inclined to proceed with the case in C.C.No.520 of 2020 and agreed not to enter any further dispute with regard to the above issue, the proceedings initiated by the 1st respondent is liable to be quashed. The joint memo of compromise shall form part and parcel of this order. Accordingly, this Criminal Original Petition is allowed and the proceedings in C.C.No.520 of 2020 on the file of Judicial Magistrate, Madhavaram is quashed.
