O R D E R
The nature of offences involved in this case is that the petitioner was selling commercial quantity of Ganja chocolate to School and College students. Bail was granted on condition to produce two sureties for 1/3
Rs.25,000/- each. It is sought to be modified to produce sureties for Rs.10,000/- each. The reason stated by the Trial Court as to why the condition that two sureties to be produced for Rs.25,000/- was imposed is that the petitioner is from Orissa and there is every chance for him to abscond to his own State of Orissa. For that reason, the said condition was imposed.
2. The learned counsel for the petitioner has forwarded a copy of the order passed by a learned Single Judge of this Court dated 20.07.2023 in Shobith Kumar vs. State represented by the Sub-Inspector of Police wherein it is stated that the petitioner shall execute a bond for a sum of Rs.10,000/- along with two sureties and to produce documents showing Rs.10,00,000/- worth assets. The learned Single Judge had modified the condition that bond for a sum of Rs.10,000/- along with two sureties is sufficient.
3. The condition imposed to produce sureties for Rs.25,000/- is not at all an onerous one. Necessary reasons have been given.
4. Hence, this petition stands dismissed.
