The petitioners/A1 and A2 seek bail in Crime No.565 of 2023 registered by the respondent police for the offences punishable under Sections 279, 304(A) and 337 of IPC and subsequently, altered into Sections 279, 337, 304(2) of IPC and Section 185 of the Motor Vehicles Act, and they have been arrested and remanded to judicial custody on 19.08.2023.

2. The petitioners were travelling in a car bearing Regn.No.TN12-W-4425 driven by the 1st accused on 19.08.2023. The driver lost his control and collided with a motorcycle bearing Regn.No.TN-12-AP-0193, as a result of which, one person died and four others sustained injuries.

3. It is contended by the learned Government Advocate (Crl. Side) on behalf of the respondent that the driver of the offending vehicle drove the vehicle under the influence of alcohol and the laboratory report of the Forensic Sciences Department has also been forwarded to the Medical Officer.

3. In view of that particular fact, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed. However, the petitioner can file a subsequent petition after a period of two weeks.
