O R D E R

The respondent/husband has moved H.M.O.P.No.178 of 2023 on the file of Subordinate Court at Thirupathur. The petitioner, from a perusal of the cause title in the HMOP proceedings, seems to be a 1/4

permanent resident of Kolathur in Chennai. The petitioner has further pleaded that she is a person who is suffering from renal failure.

2. Notice was ordered in the Tr.C.M.P, the respondent/husband has been served, but he has not entered appearance nor is he present in Court to oppose the application.

3. Taking into consideration that the petitioner wife is having a medical condition affecting her kidneys, I am able to perceive that she will not be in a position to travel to Thirupathur, which is about 200 kms from Chennai for the purpose of contesting the case.

4. In the light of the inconvenience expressed by the wife, this Tr.C.M.P stands allowed and H.M.O.P.No.178 of 2023 pending on the file of Subordinate Court at Thirupathur is withdrawn and transferred to the file of II Additional Family Court, Chennai for disposal. No costs. Consequently, the connected miscellaneous petition is closed. 26.04.2024 Index : Yes/No gpa 2/4
