ORDER

The petitioner and the respondent got married on 23.01.2019 at Tiruvottiyur, Chennai. Subsequently, the parties had fallen apart and they are before the Sub Court, Tiruvottiyur in H.M.O.P.No.144 of 2023. There were no children from the marriage.

2. The petitioner/wife pleads that she is unable to travel from Kancheepuram to Tiruvottiyur, which are about 100 Kms apart, and hence, Page No 1 of 4

seeks transfer of proceedings in H.M.O.P.No.144 of 2023 on the file of the Sub Court, Tiruvottiyur to Sub Court, Kancheepuram.

3. The husband was served on 17.10.2023, but he has not chosen to oppose this application.

4. Taking overall circumstances into consideration and giving priority to the interest of the wife, I am inclined to allow this transfer petition. Hence, the proceeding in H.M.O.P.No.144 of 2023 which is now pending on the file of the Sub Court, Tiruvottiyur, Chennai is withdrawn and it shall stand transferred to the file of the Sub Court at Kancheepuram District.

5. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed. No costs.
