Crl.O.P.No.27357 of 2022 A.D.JAGADISH CHANDIRA, J., The petitioner, who apprehends arrest for the alleged offences under Sections 379 and 430 IPC r/w.21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.255 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner had illegally transported 1/2 unit of river sand by using Bullock cart without any valid licence. Hence, the complaint.
3. The learned counsel for the petitioners would submit that the petitioner is innocent and he has been falsely implicated in this case. Therefore, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (crl.side) would submit that the petitioner has transported 1/2 unit of river sand using bullock cart. 5. Taking into consideration the fact that the petitioner is having 4 previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
