PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner's representation dated 28.07.2023 and provide a new Electricity Connection to the flat owners in Phase III, Towers C to F. WMP No.28366 of 2023 filed seeking permission to file a single Writ Petition is ordered on payment of separate Court fee.
2. Mr.L.Jai Venkatesh, learned Standing Counsel accepts notice for R1 and is armed with instructions to enable final disposal of this Writ Petition, even at the stage of admission. R2 and R3 are private parties and no notice is thought necessary to them at this juncture bearing in mind the nature of order that is passed now.
3. The petitioners seek a mandamus simplicitor for disposal of their collective representation dated 28.07.2023 asking for supply of electricity to the property at Metro Zone, Koyambedu, formerly Thirumangalam Vilage, Egmore, Nungambakkam Taluk, Chennai.
4. Mr.Jai Venkatesh, learned Standing Counsel for R1/Assistant Executive Engineer concurs on the receipt of representation dated 28.07.2023
and assures the Court as well as the petitioners that the same will be considered in accordance with the applicable rules and regulations and in accordance with law and disposed expeditiously. He also requests the Court to direct the petitioners to pay the applicable charges in that respect.
5. This goes without saying. If at all it is the petitioners' case that they have remitted all the charges already to the developer, that is a matter between them and the developer and needless to say, if the Electricity Department proceeds to accept the application, all applicable charges will be paid by the petitioners.
6. Let the representation of the petitioners be disposed after hearing them within a period of eight (8) weeks from today in accordance with applicable Rules and Regulations. This Writ Petition stands disposed in terms of this order. No costs.
