The petitioner, who was arrested and remanded to judicial custody on 31.05.2023 for the offences punishable under Sections 8(c) r/w 22(C), 25, 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.256 of 2023, seeks bail.

2. It is stated by the learned counsel for the petitioner that petitioner has been arrayed as A4 in this case and taken into custody on 31.05.2023. He has been falsely implicated in this case and prayed for grant of bail to the petitioner.

3.It has been stated by the learned Government Advocate (Crl.Side) on behalf of the respondent that the petitioner and the other three accused were found in possession of 150 box of Pyeevon Spas Plus (totally 1200 tablets) and the same was recovered from them. It had been very specifically stated that the laboratory report had revealed that the contraband seized is of commercial quantity. It had also been stated that during the confession of A3, it had been revealed that petitioner/A4 is the person, who supplies the tablets to A3, who in turn will sell the same in the retail market, through A1 and A2. Thus, he prayed 1/3

for dismissal of the petition.

4.However, the learned counsel for the petitioner contended that there is no evidence against the petitioner herein. But the fact that the petitioner is the supplier of drugs is to be examined and therefore, at this stage, I am not inclined to grant bail to the petitioner.
