This Writ Petition has been filed by the petitioner seeking a Writ of Mandamus, directing the respondents to consider his representation dated 06.07.2015 and to grant his balance gratuity amount of Rs.60,463/-.
2.Heard Mr.M.P.Saravanan, learned counsel for the petitioner. Ms.T.P.Savitha, learned Government Advocate takes notice on behalf of the respondents 1 & 2.
3.The petitioner joined as Secretary in Primary Agriculture Co-operative Society on 16.07.1974 and retired https://hcservices.ecourts.gov.in/hcservices/
from service on 30.06.2012. After his retirement, he made application to the first and second respondents on 24.07.2013 and 29.07.2013 respectively. In view of the same, he received his gratuity in part to the tune of Rs.1,00,000/- and for the balance amount, he made representation on 02.03.2015 to the respondents. The third respondent by his letter dated 27.03.2015 stated that balance amount of gratuity will be granted only after recovery of loss amount incurred due to the petitioner to the Society during his service. In regard to the same, petitioner made a representation dated 06.07.2015 giving details of the resolution passed in regard to the said recovery amount and requested to disburse his balance gratuity amount. As the same has not been considered by the respondents, he has come forward with this present writ petition.
4.The learned Government Advocate submitted that a reasonable time may be given to the respondents to dispose of the petitioner's representation.
5.Recording the statement made by the learned Government Advocate, the second respondent is directed to consider and dispose of the petitioner's representation dated 06.07.2015 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 6.The Writ Petition is disposed of accordingly.
