The petitioner seeks anticipatory bail in Crime No.21 of 2023 registered by the respondent Police originally as girl missing and later, altered to Sections 366, 376(2)(n) of IPC r/w 5(1)(j)(ii), 6 of POCSO Act, 2012 and Section 9 of the Child Marriage Act, 2006.
2.It is stated by the learned counsel for the petitioner that the petitioner herein was a minor and attained the age of majority on 10.06.2023 and subsequently, the FIR was registered on 18.07.2023.
3. The victim girl was a major and she is in the family way. 4.It is stated by the learned Government Advocate that substantial investigation has been completed.
5.However, taking into consideration the nature of the offence and the statement recorded from the victim girl under Section 164 Cr.P.C, wherein, she had been stated that the petitioner under the influence of alcohol had sexual intercourse with her, this Court is not inclined to grant anticipatory bail to the petitioner.
