PRAYER This writ petition has been filed under Article 226 of the Constitutionof India to issue a writ of mandamus directing the 2nd Respondent to immediately remove the Vehicles parked by Mr.Lingesan in front of the factory gate of the Petitioner in Violation of the status quo order and FIR.No.250/2025, and direct the Respondents to take necessary action to ensure that there is no further obstruction to the petitioner's ingress and egress to the factory premises. ORDER
The writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to remove vehicles parked by the third respondent in front of the petitioner's factory gate, thereby obstructing ingress and egress to the petitioner's premises.
2. I have heard the learned Senior Counsel appearing for the petitioner, learned Additional Public Prosecutor appearing for the respondents 1 and 2 and the learned Senior Counsel appearing for the third respondent and perused the materials available on records carefully.
3. This Court, by its earlier order dated 22.08.2025, had directed the first respondent to nominate an officer in the rank of Assistant Commissioner of Police to investigate the matter. The investigation has to be conducted on the basis of all the FIRs registered in connection with the said issue and a Status Report was directed to be filed before this Court. Pursuant to the same, a Status Report has been filed before this Court today. 3 / 6
4. On a careful perusal of the Status Report, this Court is of the view that the involvement of lawyers enrolled before the Bar Council of Tamil Nadu is disclosed. It has now become a fashion for some lawyers to form a gang as a group and engage themselves in eviction and taking possession of properties illegally. If such action is not controlled by this institution, the public will lose faith on the institution, and it will be difficult to identify, who are good and bad lawyers. The public is not in a position to identify who is a good lawyer. This situation has already been reached. Since lawyers are members of a respected profession, involvement of these types of lawyers in such acts would spoil the image of the larger section of the noble profession.

In such view of the matter, (i) The Bar Council of Tamilnadu is directed to take immediate action and initiate disciplinary proceedings against the lawyers, who were involved in this matter and indicated in the status report of the respondent police. (ii) In the meanwhile, the respondent police shall proceed to secure the lawyers in accordance with law and file a final report against them. 4 / 6
(iii) The petitioner and respondent are at liberty to adjudicate their respective rights before the Civil Court.
