ORDER

By this petition, the intending appellant seeks the condonation of the delay of 42 days in filing the appeal. In the affidavit in support of the petition, it is stated that the appeal could not be lodged in time on account of the illness of the individual appellant, which resulted in delay in coordinating with the counsel.

2. Learned counsel for the first respondent leaves it to the Court to decide on this petition. Although private notice was despatched to the second respondent, such notice was returned with the endorsement "left". Learned counsel for the petitioner / intending appellant submits that he is unaware of any other address of the second respondent. In these circumstances, this petition is proceeded with in the absence of the second respondent.

3. Upon examining the reasons set out in the petition and being satisfied that sufficient cause is shown, this petition is allowed by condoning the delay. Consequently, the Registry is directed to number the appeal, if otherwise in order.
