The Respondent filed a suit in O.S.No.125 of 2020 on the file of the Additional District Judge, Hosur, for declaration of title based upon the patta. The defendant Hosur Municipality stated that the suit property is earmarked as public park and the suit was decreed and hence the Commissioner of Hosur Municipality filed an Appeal, with a delay of 94 days. 2.The learned counsel for the Respondent would submit that after decreeing the suit, the Municipality has moved the RDO for cancellation of patta, which has to be gone into in the Appeal. 3.Heard the learned counsel appearing on either sides. 4.With regard to the delay in filing the Appeal, having been satisfied with the reasons stated in the affidavit filed in support of this condone delay Petition and the submissions made by the learned counsel for the Petitioner, this condone delay Petition is ordered on payment of Rs.500/- to the learned counsel for the Respondent within a period of one week from the date of receipt of a copy of this order.
