Respondents Petition under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the first respondent herein to number the statutory Revision Petition dated 16.09.2022 filed under Section 10-A of the Tamil Nadu Land Encroachment Act, 1905 challenging the Eviction Notice in S.M.Na.Ka.No.11312/2022/A4 dated 19.07.2022 passed by the second respondent herein and to dispose of the same in accordance with law after giving due opportunity to the petitioner. ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) This writ petition has been filed praying for issuance of a mandamus directing the Secretary to Government, Revenue & Disaster Management Department, Chennai to number the statutory Revision Petition dated 16.09.2022 filed by the petitioner under Section 10-A of the Tamil Nadu Land Encroachment Act, 1905 challenging the eviction notice in

S.M.Na.Ka.No.11312/2022/A4 dated 19.07.2022 issued by the second respondent herein and to dispose of the same in accordance with law after giving due opportunity to the petitioner.

2. When the matter was taken up, Mr.J.Ravindran, learned Additional Advocate General appearing for the respondents fairly submitted that the statutory revision petition dated 16.09.2022 filed by the petitioner will not only be numbered and taken up on file, but will also be disposed of on merits and as per law by the Secretary to Government, Revenue & Disaster Management Department within a period of four weeks.

3. Recording the same, we direct the Secretary to Government, Revenue and Disaster Management Department, Fort St.George, Chennai to take on file the revision petition dated 16.09.2022 filed by the petitioner against the order passed by the second respondent dated 19.07.2022 and dispose of the same on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With

this direction, the writ petition stands disposed of accordingly. Consequently, W.M.P.No.32327 of 2022 is closed. However, there is no order as to costs.
