CMP Nos.23533, 23534 and 23535 of 2019 have been filed by the petitioners i)to condone the delay of 3022 days in filing the petition to set aside the abatement caused due to the death of the sole respondent Sengottiayan; ii) to set aside the abatement caused due to the death of the sole respondent and iii) to bring on record the legal representatives of the deceased sole respondent as respondents 2 to 4 in the above Second Appeal.

2. Heard the learned counsel for the petitioners.

3. Mr.Rajinesh Pathial has filed vakalth on behalf of the proposed respondents and has no objection for allowing these petitions.

4. Having regard to the reasons stated in the affidavit filed in support of these petitions and this Court being satisfied with the same, these CMPs are allowed as prayed for.

5. Registry is directed to carry out necessary amendments and list the main Second Appeal for hearing on 03.01.2020.

6. Registry is also directed to print the name of Mr.Rajinesh Pathial as counsel for the proposed respondents and remove the name of K.Vasuvenkat as counsel on record for the respondent on the next hearing date.
