ORDER
This Criminal Original Petition has been filed to quash the proceedings in Spl.C.C.No.60 of 2019, on the file of the Mahila Court, Coimbatore.
2. Heard Mr.A.Saravanan, learned Counsel appearing on behalf of the petitioners and Mr.A.Gopinath, learned Government Advocate (Crl. Side) for the first respondent.
3. It is seen from records that the first petitioner has married the second respondent and the marriage was also registered before the Marriage Registrar, Coimbatore on 05.09.2022. Through the marriage, there are two children born for the petitioner and the second respondent namely, Hariharan, aged five years and Moshita Meenakshi, aged one year. In view of this development, the petitioners have sought for quashing the proceedings.
4. The first petitioner and the second respondent along with the children were present before this Court. This Court had the advantage of enquiring the parties and it is seen that the first petitioner and the second 3/6
respondent are happily married and they have two children. The second respondent is not interested in prosecuting this case. The second and third petitioners are the uncles of the first petitioner.
5. In the considered view of this Court, the present case comes within the parameters laid down by the Hon'ble Apex Court in Parbathbhai Aahir @ Parbathbhai Vs. State of Gujrath1 and The State of Madhya Pradesh Vs. Dhruv Gurjar and Another2. The continuation of the proceedings will only result in abuse of process of law and it will not yeild any result due to the subsequent development.
6. In view of the above, the proceedings in Spl.C.C.No.60 of 2019 on the file of the Mahila Court, Coimbatore are hereby quashed and this Criminal Original Petition is allowed on the account of compromise.
